Acceptable Use Policy

Rules and restrictions that govern acceptable use of the EverBee services operated by EverBee, Inc.

This Acceptable Use Policy (“AUP”) sets out the rules that apply to your use of the EverBee platform and any services provided by EverBee. EverBee is a product owned and operated by EverBee, Inc. (“EverBee”, “we”, “our” or “us”).

This AUP is incorporated by reference into the EverBee Terms of Service and forms part of the binding agreement between you and EverBee. By using the Services you confirm that you accept this AUP and will comply with it. If you do not agree to this AUP, you must not use the Services.

Prohibited activities

You must not use EverBee to engage in, facilitate, or promote any of the following:

Illegal or harmful content

  • Any activity that is unlawful, fraudulent, or harmful, or in connection with any unlawful, fraudulent, or harmful purpose or activity.
  • Content that violates any applicable local, national, or international law or regulation.
  • Content that is defamatory, obscene, offensive, hateful, or inflammatory, or that promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age.
  • Content that contains or promotes violence, terrorism, or extremism of any kind.
  • Content that is sexually explicit or pornographic, or that sexually exploits or endangers minors in any way. We will report any such content to the relevant law enforcement authorities.
  • Content that promotes, sells, or distributes illegal drugs, controlled substances, or paraphernalia.
  • Content that promotes, sells, or distributes firearms, ammunition, or weapons in violation of applicable law.

Intellectual property infringement

  • Selling or distributing counterfeit goods, pirated software, or any other content that infringes the intellectual property rights (including copyright, trademark, patent, and trade secrets) of any third party.
  • Using any trade mark, logo, or other proprietary information of EverBee, EverBee, or any third party without the express written permission of the owner.
  • Removing, obscuring, or altering any copyright or other proprietary notices contained in or on the Services.

Platform abuse and security

  • Transmitting any unsolicited or unauthorised advertising or promotional material, or any other form of similar solicitation (spam).
  • Knowingly transmitting any data or sending or uploading any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
  • Attempting to gain unauthorised access to any part of the Services, the server on which our site is stored, or any server, computer, or database connected to our site.
  • Attacking our site via a denial-of-service attack or a distributed denial-of-service attack.
  • Attempting to reverse-engineer, decompile, disassemble, or otherwise derive source code from any portion of the Services.
  • Scraping, crawling, or using any automated method to collect data from the Services without our prior written consent.
  • Creating or registering multiple accounts to circumvent limits, bans, or restrictions imposed by EverBee.
  • Misrepresenting your identity, impersonating any person or organisation, or falsely stating or otherwise misrepresenting your affiliation with a person or organisation.

Prohibited use of the Services and data

You must not use EverBee, or any data or insights obtained through EverBee, to do any of the following, regardless of whether such conduct is legal in your jurisdiction:

  • Research, create, or sell counterfeit goods or goods that infringe any intellectual property rights, including unauthorised replicas of branded merchandise.
  • Scrape, harvest, or bulk-extract data from the Services by automated means outside the features we provide, or attempt to circumvent plan limits, rate limits, or access controls.
  • Resell, sublicense, or redistribute EverBee data, reports, or exports as a competing product or dataset.
  • Harass, dox, or target individual sellers or shops surfaced through the Services.
  • Misrepresent EverBee estimates or analytics as guaranteed earnings in any promotion, course, or offer.
  • Any use that EverBee reasonably determines, at its sole discretion, poses unacceptable legal, reputational, or other risk to EverBee or the wider community.

Data privacy

  • Collecting, storing, or processing personal data of your customers or visitors in violation of any applicable data protection law, including the GDPR, CCPA, or any other applicable privacy regulation.
  • Using personal data obtained through the Services for purposes other than operating and growing your own business in accordance with your own privacy policy.
  • Selling, renting, or otherwise transferring personal data obtained through the Services to third parties for their own marketing purposes.

Marketplace and research-data rules

Because EverBee is built for Etsy product research, the following additional rules apply to your use of research data and any connected marketplace accounts:

  • Marketplace compliance. You must comply with the terms of service of Etsy and any other marketplace you connect or research, including their rules on intellectual property, listing accuracy, and buyer protection.
  • No infringing artwork. You must own or hold a valid licence for all artwork, designs, text, and other creative content you create or list based on research insights. Using unlicensed fan art, trademarked characters, celebrity likenesses, or copyrighted images without authorisation is strictly prohibited.
  • Estimates are estimates. Sales, revenue, and trend figures shown in EverBee are analytical estimates. You must not present them to third parties as exact or guaranteed figures.
  • Customer protection. You must honour your stated returns, refunds, and exchange policies in your own shop and must not deceive or harm your customers.

Monitoring and enforcement

EverBee does not actively monitor all content or activities conducted through the platform, but we reserve the right (though not the obligation) to review any content and investigate any alleged violation of this AUP.

If we determine that a violation of this AUP has occurred, we may, without limiting any other remedies available to us:

  • Issue a warning to the user;
  • Suspend or terminate the user’s account and access to the Services;
  • Remove or disable access to any content that violates this AUP;
  • Report the activity to relevant law enforcement or regulatory authorities; and/or
  • Take legal action against the user.

We will not be liable for any loss or damage caused by a failure to detect a violation or by any action we take in response to a violation.

Reporting a violation

If you become aware of any content or activity on the EverBee platform that you believe violates this AUP or any applicable law, please report it to us at hello@everbee.io. We will investigate all legitimate reports.

Changes to this policy

We may revise this AUP from time to time. The “Last updated” date at the top of this page reflects when this policy was last changed. Where revisions are material, we will provide reasonable notice by email or via a notice on the EverBee dashboard. Your continued use of the Services after such notice constitutes acceptance of the revised AUP.
